The Secretary of HHS can reduce the amount of a fine or waive it entirely if the violation wasn’t due to willful neglect of the requirements, and if the entity works with the Office of Civil Rights (OCR), for privacy violations, or the Center for Medicare and Medicaid Services (CMS), for all other HIPAA violations, to correct the violation. This may be through technical assistance, education, or a corrective action plan developed between the covered entity and OCR or CMS.

The new enforcement rule emphasizes HHS’s desire to correct violations informally without levying penalties. Generally, though, if willful neglect is demonstrated, civil penalties are likely to be levied.

Please note a correction to the Dec 1 HIT Blawg post. CCHIT also announced today the first product certified in the CCHIT Certified 2011 Comprehensive program. See http://www.cchit.org/products/2011/ambulatory/1483. All products certified in that program meet or exceed all of the proposed Federal standards supporting achievement of meaningful use for qualification of ARRA incentive funding.

American Well is another block in the growing reshaping/disrupting of the current health care structure that you and I have discussed. Very interesting model to watch.

The model also might attract those physicians who are continuing to be disenchanted by the idea of opening or continuing to run their own practice. Be a free agent independent contractor.

You hit on a couple of the key legal issues for us to watch:
1. privacy/security issues
2. med mal litigation issues for web-exams. Along with this will go licensure issues that that current licensing process hasn't contemplated (except in teleradiology).
3. scope of medical service/advice that can be given via a web-exam.

Yes, I lament this vey thing often. My IT department or the hospitals I work with can't beleive what I am asking them to do, but I can google something and find five different free programs that do the same thing for sports, movies, or social media!

Thanks for the creation of this site. This is an area where discussion and debate are certainly needed.

There are still major issues with medical practice systems being able to communicate with each other. We still rely too much on phones and faxes.

Another area where we seem to be lagging is in the development and use of smart cards that would integrate medical, financial and demographic data.

Good luck with your blog and I look forward to reading it often.
